Critical CGT Deadline Australian Property Investors Cannot Overlook

2026.10.10

Australia’s 2026 Federal Budget delivered the most sweeping propertytax overhaul in decades, targeting CapitalGainsTax (CGT) and negativegearing. Major changes take effect 1 July 2027, with grandfathering protections for prereform holdings. This deadline requires close attention from existing property investors.

Core Policy Changes

1. Overhaul of the 50 % CGT Discount

From 1 July 2027, the longstanding 50 % capitalgainstax discount for residential assets held over 12 months will be abolished. It will be replaced by inflationindexed cost relief alongside a 30 % minimum tax rate on net capital gains.

✨ Grandfathering: Capital appreciation accrued before 1 July 2027 remains eligible for the old 50 % CGT discount.

Newbuild option: Investors purchasing brandnew residential dwellings post1 July 2027 retain the choice between the original 50 % discount or the new indexation framework.

Exemptions: Newbuild developments, superannuationheld assets and commercial realestate sit outside these reforms.

2. Negativegearing restrictions

Starting 1 July 2027, negativegearing deductions will only be permitted for newbuild residential properties.

✨ Grandfathering: Established investment homes held prior to the 12 May 2026 budget announcement keep existing negativegearing entitlements. Selfmanagedsuperfund assets and commercial property remain unaffected.

⚠️ Established existing residential properties purchased after 12 May 2026 cannot offset rental losses against other personal taxable income from 1 July 2027 onwards. Losses may be carried forward to offset future rental income or future capital gains.

Practical Takeaways For Different Investor Groups

1. Existing investment properties (bought before 12 May 2026) Grandfathered status preserves oldrules negativegearing. Value growth accrued before 1 July 2027 qualifies for the 50 % CGT discount. There is no mandatory firesale requirement, but investors should recalculate post2027 holding cashflow projections.

2. Prospective buyers of preowned established homes Properties purchased after 12 May 2026 lose negativegearing incomeoffset capacity from July2027 onwards. Investment decisions must place greater weight on rental cashflow rather than tax offsets.

3. Newbuild purchasers Negativegearing access remains intact. For CGT purposes investors can select whichever delivers better outcome: the legacy 50 % discount or new inflation indexation.

4. Investors considering asset disposal Capital gains will be split according to when value appreciation occurred. Gains builtup before 1 July 2027 receive oldrule concessions; postreform gains fall under new legislation. There is no compulsory sellby deadline. Avoid restructuring longterm portfolios purely for taxdriven reasons.

Broader Market Spillover Effects

Higher holding costs for established residential stock will force investors to prioritise rental yield. Some investors may step back from establishedproperty markets, potentially easing competition for firsthomebuyers. Newbuild residences, commercial assets and superfund investment vehicles are drawing increased investor focus.

Important note: Tax is only one component of realestate decisionmaking. Avoid headlinedriven impulsive moves. Location, tenant demand and asset scarcity remain primary longterm performance drivers.
